1. Introduction
Thank you for using the MyAccownt.com Services (including our website, mobile and web-based applications, and any other related tools or products provided by Accownt LLC, “Accownt”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.
2. Using the Services
You may access and use our Services only in accordance with these Terms and any additional guidelines we provide. You agree not to misuse the Services—this includes interfering with the proper operation of the Services, using methods other than those we provide, or copying content excessively. Any unauthorized use may result in suspension or termination of your access.
3. Your myAccownt Account
To use certain features, you must register an Account on MyAccownt.com. You agree that all information you provide is accurate and current. You are responsible for safeguarding your account credentials and for all activities that occur under your account. If your account is accessed without your permission, you must notify us immediately at support@myaccownt.com.
4. Payment, Fees, Refunds, and Cancellation
Our Services are offered on a subscription basis. All subscription fees are non-refundable. Payments are processed securely via Paddle, and by subscribing you agree to the recurring billing terms set forth on our Products page. You may cancel your subscription at any time to prevent future billing; however, no refunds or pro-rated credits will be provided for the current billing period.
5. Intellectual Property
All content and materials on MyAccownt.com — including designs, software, text, graphics, and logos — are the exclusive property of Accownt LLC or our licensors. Certain features of the Services are protected by one or more pending patent applications in the United States and other jurisdictions. Patent Pending. You are granted a limited, non-exclusive, non-transferable license to use our Services solely for your internal business purposes. You may not copy, modify, decompile, reverse-engineer, distribute, or create derivative works of any portion of the Services without our prior written permission.
6. Service Level Agreement
This Service Level Agreement (“SLA”) is an addendum to the agreement between Accownt LLC (“Provider”) and you (“Customer”) governing the use of Provider’s online services (the “Services”). Provider does not commit to any specific service levels; all services are provided on a best‑efforts basis.
6.1. Services Covered
This SLA applies only to the Services expressly described in the underlying agreement.
6.2. Best‑Efforts Support
- Support Channels: Provider may offer support via email or ticket system.
- No Guaranteed Response: Provider will use commercially reasonable efforts to respond to inquiries but makes no promise of response time, turnaround, or resolution.
6.3. Service Availability
- Provider does not warrant or guarantee any specific level of service availability, performance, or reliability.
- All Services are provided “AS IS” and “AS AVAILABLE.”
6.4. Maintenance and Changes
- Provider may, at its sole discretion and without notice, modify, suspend, or discontinue any aspect of the Services (including features, functionality, or support).
- There is no obligation to schedule or provide maintenance windows or notifications in advance.
6.5. Errors, Omissions & Defects
- Provider does not warrant that the Services will be error‑free, uninterrupted, or free of vulnerabilities.
- No service credits, refunds, or other remediation shall be owed for any interruptions, defects, or security incidents.
6.6. Customer Responsibilities
- Customer is solely responsible for data backup, security, and compliance with applicable laws in connection with its use of the Services.
- Provider may, but is not obligated to, assist with troubleshooting at Provider’s discretion.
6.7. Warranty Disclaimer
EXCEPT AS EXPRESSLY SET FORTH IN THIS SLA, PROVIDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.8. Limitation of Liability
- No Indirect Damages: In no event shall Provider be liable for any indirect, incidental, special, punitive, or consequential damages.
- Aggregate Cap: Provider’s total aggregate liability under this SLA shall not exceed the total fees actually paid by Customer for the Services in the six (6) months preceding the claim.
6.9. Term and Termination
This SLA is effective as of the date of the underlying agreement and continues until that agreement terminates. Termination of the underlying agreement automatically terminates this SLA.
6.10. Miscellaneous
If any provision of this SLA is held unenforceable, the remainder will remain in full force and effect. This SLA is governed by the law specified in the underlying agreement.
7. User Obligations and Prohibited Conduct
You agree not to:
- Interfere with or disrupt the operation of the Services;
- Attempt to access the Services by any means other than the interface and instructions provided;
- Reverse engineer, decompile, or otherwise attempt to derive the source code of our software;
- Use the Services for generic, general, repurpose, or multi-plan sponsor purposes for any individual subscription;
- Use the Services to engage in any unlawful or unauthorized activity.
8. Disclaimers and Limitation of Liability
Our Services are provided “as is” and “as available,” without any warranties—express, implied, or statutory. Accownt LLC does not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components. In no event shall Accownt LLC be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services.
9. Indemnification
You agree to indemnify and hold harmless Accownt LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of the Services or your breach of these Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Washington. By creating an account on our Services, you expressly agree to and acknowledge these Terms, and your account creation signifies your acceptance of all terms and conditions contained herein. Any disputes arising from these Terms or your use of our Services shall be resolved exclusively by binding arbitration administered under Washington law, rather than through litigation in any court. By agreeing to these Terms, you waive your right to a trial by jury.
11. Modifications and Termination
We reserve the right to modify or terminate the Services or these Terms at any time. Any modifications will be posted on our website and become effective immediately upon posting. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
